INTELLECTUAL PROPERTY IN UKRAINE: EUROPEAN EXPERIENCE IN THE CONTEXT OF SUSTAINABLE DEVELOPMENT AND DIGITAL TRANSFORMATION

The article provides a comprehensive legal analysis of the European experience in regulating intellectual property within the context of digital transformation and the development of the EU Digital Single Market. The evolution of the European model of intellectual property rights protection and the peculiarities of the functioning of the digital market are analyzed. It examines the institutional and normative mechanisms of intellectual property protection in the European Union, including the activities of the European Patent Office (EPO) and EUIPO, the legal impact of Directive (EU) 2019/790 on copyright in the digital environment, and the provisions of the AI Act regulating artificial intelligence. Particular attention is paid to the role of online platforms, algorithmic systems, creative industries, and digital services in shaping a modern model of IP protection. A comparative assessment of EU and Ukrainian approaches to the implementation of intellectual property standards is conducted, highlighting legislative gaps, institutional challenges, and risks associated with harmonization. The study substantiates the need for a gradual alignment of Ukrainian legislation with the EU acquis as a strategic prerequisite for sustainable development, innovation-driven economic growth, and integration into the European legal and digital space.
